Welcome to Everchill Fashion (“Everchill”, “we”, “our”, or “us”). By accessing our website, mobile application, or placing an order with us, you agree to be bound by the following Terms and Conditions. Please read them carefully.
1. General Terms of Use

By using the platform www.everchillfashion.com, you confirm that you are at least 18 years of age (or accessing under parental guidance) and are legally competent to agree to these Terms.
1.2 Modifications
Everchill reserves the right to modify, update, or remove any part of these Terms at any time without prior notice. Continued use of our platform indicates your acceptance of such changes.
1.3 Eligibility
Only users capable of forming legally binding contracts under the Indian Contract Act, 1872 may use our services.
2. User Accounts
2.1 Registration
You must create an account to make purchases. You agree to provide accurate, current, and complete information and to maintain the security of your login credentials.
2.2 Responsibilities
You are solely responsible for all activities under your account. Everchill is not liable for unauthorized account use.
3. Product Information and Pricing
3.1 Accuracy
We strive to ensure all product descriptions, images, and pricing are accurate. However, slight variations in color or texture may occur due to device screens or production.
3.2 Pricing Errors
In case of any pricing or listing error, we reserve the right to cancel or refuse orders, even if payment is completed.
3.3 Taxes
All prices are listed in INR and are inclusive/exclusive of applicable taxes as indicated.
4. Orders and Payment
4.1 Order Acceptance
Order confirmation is subject to stock availability, payment verification, and address confirmation. Everchill may cancel any order at its discretion.
4.2 Payments
We accept UPI, debit/credit cards, wallets, and cash on delivery (COD). Payment must be completed before order dispatch, except for COD.
4.3 COD Policy
COD is subject to serviceability of the address and may incur additional charges. Maximum COD value may be limited.
5. Shipping and Delivery
5.1 Timelines
Orders are typically shipped within 1–2 business days and delivered within 5–7 working days, subject to your location.
5.2 Tracking
Once dispatched, tracking details will be shared. Shipping delays due to natural calamities, logistics issues, or force majeure are beyond our control.
5.3 Charges
Shipping is free for orders above a defined threshold. Charges may apply for lower-value orders or specific pin codes.

6. Return, Exchange & Refunds
6.1 Return & Exchange
Products may be returned or exchanged within 7 days of delivery if unused and in original packaging. Certain items like innerwear, socks, and discounted products are non-returnable.
6.2 Refunds
Refunds (where applicable) will be initiated after quality checks and processed within 7–10 business days to the original payment method.
6.3 Defective Products
If you receive a defective or incorrect product, notify us within 48 hours. We'll arrange for a replacement or refund.

7. Intellectual Property
7.1 Ownership
All trademarks, logos, product designs, images, and content on the platform are the property of Everchill Fashion. Unauthorized use is prohibited.
7.2 Limited Use
You may not modify, reproduce, transmit, display, or sell any content without our express written consent.

8.1 Prohibited Activities

Violation may lead to termination or legal action.
9. Third-Party Links
We may link to third-party websites (e.g., Instagram, logistics partners). Everchill is not responsible for their content or practices. Use them at your own risk.
10. Limitation of Liability
Everchill is not liable for any indirect, incidental, special, or consequential damages arising from:

11. Force Majeure
We are not responsible for failures or delays due to causes beyond our control including but not limited to acts of God, war, strikes, lockdowns, natural disasters, and government orders.
12. Governing Law & Dispute Resolution
12.1 Jurisdiction
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in [Mumbai, India].
12.2 Resolution
In the event of a dispute, we encourage amicable resolution. Unresolved disputes may be referred to arbitration as per the Arbitration and Conciliation Act, 1996.
